HR 6594 and Our Fight

Carolyn Maloney is full of Baloney!  Her bill takes away the freedom of choice in healthcare that she told the NYC Council every American has.  She apparently has not read her bill, and misrepresents is provisions. 

HR 6594 read it here, and see for yourself and then check out the exact lines that are highlighted that shows her bill, HR 3543 only designates the FDNY as the sole provider treatment center for FDNY responders, WITH NO CHOICE to go anywhere else. The below passages are some highlights that show you Carolyn Maloney is full of baloney when she says a 9/11 hero has freedom in choice of healthcare.  She is truly forcing all heroes to either submit to healthcare at their employer or former employer or just don't bother getting care. 

Highlights of Maloney's Baloney

  • Designated Center of Excellence for FDNY responders is ONLY the FDNY

     On Page 33 under “Center of Excellence Defined,” line 4-12, it states, “(A) FOR FDNY RESPONDERS IN NEW YORK – With respect to an eligible WTC responder who responded to the 9/11 attacks as an employee of the Fire Department of the City of New York and who resides in the New York metropolitan area, such Fire Department (or such entity as has entered into a contract with the Fire Department for monitoring and treatment of such responders).”
    • This provision states that the Center of Excellence for FDNY Responders is the FDNY.   FDNY Responders should have the freedom to choose the center of excellence to get their monitoring and treatment and not be forced back to their former employer.
  • Designated Center of Excellence for FDNY responders in the NY Metro area once again, is ONLY the FDNY.  (NO FREEDOM)

    On page 34 line 22-24 to page 35 lines 1-2, it states, “(A) FOR FDNY RESPONDERS IN NEW YORK – With respect to an eligible WTC responder who responded to the 9/11 attacks as an employee of the Fire Department of the City of New York, such Fire Department.
    • This provision again defines the Center of Excellence for FDNY responders as only the FDNY. 
  • Designated Center for care, only the FDNY for FDNY employees
    On page 41 lines 21-24 and page 42 lines 1-2 it states, “ (2) The term ‘current consortium arrangements’ means the arrangements as in effect on the date of the enactment of this title between the National Institute for Occupational Safety and Health and the Mt. Sinai coordinated consortium and the Fire Department of the City of New York.”   And page 42 lies 17-24, “The term ‘Mt Sinai coordinated consortium’ means the consortium coordinated by Mt Sinai hospital in New York City that coordinates the monitoring and treatment under the current consortium arrangements for WTC responders other than with respect to those covered under the arrangement with the Fire Department for the City of New York.
    • Since November 2007, NIOSH decided that all retirees of the FDNY had the right to select the center of excellence of their choice to seek care.  This bill is in conflict with itself, given this provision, as the rest of the bill defines the Center of Excellence for FDNY responders as solely the FDNY. This must be corrected.
  • Employees of the FDNY have even less rights, they have no other options as the FDNY must provide all treatment and monitoring

    On page 50 lines 17-25 and Page 51 lines 1-3, it states, “In the case of an eligible WTC responder who is an active member of the Fire Department of the City of New York, the responder shall receive such benefits as part of the individual’s periodic company medical exams.” 

    • The FDNY should not be forcing its workforce into an WTC monitoring program.  They compel all workers to particpate in their annual medical exam which by NFPA and Civil Service Regulations must be conducted.  The City of NY has conducted these exams since their inception, and now, in order to get Federal funding, they converted this exam into the WTC Monitoring exam and charge the Federal Government for it.  Yes, you read that correctly.  The Mayor and The FDNY now has the Feds pay for something they are, and have been obligated to conduct.  (Remember where the Feds get their money...yes, our tax dollars).
